§ 1. General provisions#
- These Terms of Service set out the rules for using the “Roamcrown” mobile app (in Polish app stores: “Roamcrown – Władca Gminy”), the public websites (home page, player profiles, pages of municipalities (gminy), counties (powiaty) and voivodeships (województwa)) and the web panel at https://roamcrown.com (together: the “Service”). These are terms and conditions for the provision of services by electronic means within the meaning of Article 8 of the Act of 18 July 2002 on the Provision of Electronic Services (ustawa o świadczeniu usług drogą elektroniczną) and contain the information required by the Act of 30 May 2014 on Consumer Rights (ustawa o prawach konsumenta).
- The service provider is Konrad Litwinowicz, running a sole proprietorship entered in the Central Register and Information on Economic Activity (CEIDG), address: ul. Zawidowska 21 lok. 11, 54-106 Wrocław, NIP 8982297401, REGON 526287974 (the “Service Provider”, “we”).
- Contact with the Service Provider: e-mail kontakt@roamcrown.com or in writing to the address given in para. 2. This e-mail address is also the point of contact for users and authorities within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065 on a Single Market for Digital Services (the “DSA”); we correspond in Polish or in English.
- The rules for processing personal data are described in the Privacy Policy.
- Prize competitions have separate rules (§ 12), and partner discounts are subject to the conditions stated with the offer (§ 13).
- Use of the Service is free of charge, except for the paid Premium subscription (§§ 10–11). The game and the competition (completing municipalities, rankings, Ruler titles, friends, clubs, municipality duels, basic badges, competitions) are and will remain free of charge. The Service does not display advertisements.
- These Terms of Service are made available free of charge at https://roamcrown.com/regulamin and in the app (Settings → Terms of Service), in a form that allows them to be downloaded, stored and printed.
§ 2. Definitions#
- User — a person using the Service; Player — a User with an account on the server.
- Consumer — a User who is a consumer within the meaning of Article 22¹ of the Civil Code. The provisions on Consumers also apply to a natural person concluding a contract directly related to their business activity where the content of the contract shows that it is not of a professional nature for that person, arising in particular from the subject of the business activity they pursue, as disclosed under the provisions on CEIDG (Article 7aa of the Act on Consumer Rights, Articles 385⁵ and 556⁴ of the Civil Code) — hereinafter: a “trader with consumer rights”.
- Guest account — a local account on the phone, without signing in, without synchronisation and rankings.
- Activity — a walk, run or bike ride recorded in the app or imported (GPX file, Health Connect, a connected watch service).
- Completed municipality — a municipality within whose boundaries the route of an Activity covers at least 500 m (the threshold may change, § 6(7)), or a municipality added manually or from a photo (for the collection only).
- Season — a calendar month according to Polish time.
- Ruler of the Municipality (Władca Gminy) — the Player with the highest number of points in a given municipality in a completed Season, separately in the “on foot” mode (walking and running) and the “by bike” mode.
- Club — a group of Players (up to 200 people, one club per Player at a time).
- User Content — the display name, profile photo (from the Google account, when signing in with Google), club name and description, the content of reports and appeals, and other content entered by the User.
- Premium — a paid subscription to additional features (§ 10), which is a digital service within the meaning of the Act on Consumer Rights.
§ 3. Types of services#
The Service Provider provides the following services by electronic means:
- Account and app — recording routes with GPS (with pause and emergency saving on the phone), importing GPX files (in the app and in the web panel), importing workouts from Health Connect, counting steps with the phone's sensor while recording a walk or run, importing daily step totals from Health Connect, importing the history of visited municipalities from photo locations (processed solely on the phone); automatic completion of municipalities, a map showing progress across municipalities, counties and voivodeships, badges, albums of places and historic monuments, fun facts about municipalities, a year-in-review summary.
- Competition and social features — the monthly competition for the title of Ruler of the Municipality, rankings, friends, clubs and club control of municipalities, municipality duels, a step ranking (weekly and monthly), a feed with cheering, notifications, a shareable activity card, a public profile.
- Public websites — the home page, pages of municipalities, counties and voivodeships with rankings, public player profiles, legal documents, the account deletion page; available without signing in.
- Web panel (after signing in with a Google account or with an e-mail address and password) — uploading multiple GPX files, statistics, planning a route through not-yet-completed municipalities with GPX export (a straight line through points, without road routing — you must check the route yourself before setting out).
- Waiting list on the home page — an e-mail message about the launch of the app (with consent, with the option to unsubscribe at any time).
- Integrations with Garmin, Polar, COROS, Suunto, Wahoo and Strava — made available gradually, after the Service Provider is accepted into those companies' partner programmes; only the integrations shown on the connections screen are available in the app. The availability of integrations depends on their providers and may change. Activities imported from Strava count solely towards the Player's own collection (not towards rankings, the Season, competitions, clubs or the feed), because the Strava API terms allow this data to be shown only to its owner. Integration providers (including Strava) are not parties to the contract with the User, give no warranty as to the operation of the integration and are not liable to the User for its operation; this does not limit the Service Provider's liability towards a Consumer under the law.
- Premium — paid additional features (§§ 10–11).
- Municipality challenges, partner discounts and competitions — when currently running (§§ 12–13).
§ 4. Technical requirements and risks#
- App: a smartphone with Android 8.0 or later, with a GPS module and Google Play services (signing in with a Google account, purchases, notifications). A version for iPhone (iOS) is in preparation and is not yet available. Internet access is needed for synchronisation (recording works without a network).
- Websites and panel: a current version of a popular browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript enabled (panel, sign-up form) and support for the cookies necessary for signing in to the panel.
- Recording requires location permission “while using the app”; a recording started in the app continues even when the screen is locked (with a persistent notification). GPS recording uses battery and data transfer (map).
- Specific risks associated with the use of electronic services (Article 6 of the Act on the Provision of Electronic Services): malware, takeover of the Google account or of the password to the Service account, phishing (fake messages impersonating the Service), use of unsecured Wi-Fi networks. Protect access to your phone, your Google account and your Service password. We never ask for your Google account password or your Service account password (we do not ask for them by e-mail, by phone or in messages). You enter your Service password only in the app or on pages at https://roamcrown.com (web panel, account deletion, setting a new password via the link in an e-mail).
§ 5. Account and conclusion of the contract#
- An account on the server is created by signing in with a Google account or by registering with an e-mail address and password (in the app or in the web panel). Before the first sign-in with a Google account, or when registering by e-mail, the User ticks acceptance of the Terms of Service and the Privacy Policy and confirms being at least 16 years old. When registering by e-mail, we send a confirmation link to the address provided (valid for 24 hours; a new one can be requested); password sign-in works only after the link is clicked, and a registration whose address is not confirmed within 7 days is deleted. The contract for the provision of (free) services is concluded when the account is created (when registering by e-mail — when the address is confirmed), for an indefinite period. Using the public pages without signing in does not require creating an account; the contract for browsing the pages is concluded for the duration of their use.
- An account may be created by a person who is at least 16 years old. A minor (aged 16–17) should use the Service with the knowledge of a parent or guardian, and purchasing Premium requires their consent (the purchase is made from the payment account in Google Play or from the card used by the User). If we learn that an account was created by a person under 16, we will delete it.
- One person — one account. Accounts may not be resold or shared. A Player who signs in with a password keeps it secret and does not share it with anyone (we recommend a password not used on other services); if they suspect that someone has learned the password, they should set a new one without delay, and may also write to kontakt@roamcrown.com. A Player resets a forgotten password using a link sent to the account address (“Forgot password” (Nie pamiętam hasła), link valid for 1 hour); setting a new password this way signs the account out on all devices. A password can be added to a Google account in the app Settings, and signing in with a Google account whose address matches a confirmed e-mail account links to that same account (Privacy Policy, point 3.12).
- The initial display name is the first and last name from the Google account or — when registering by e-mail — the name provided at registration; the Player may change it. When an account is created, a private profile is selected by default: strangers see the Player as “Private player” (Gracz prywatny), and their profile has no public page. The Player may change this at any time.
- The Player may at any time download their data and delete the account in the app or at https://roamcrown.com/konto/usun. Deletion is immediate and irreversible: activities, completions, titles (including historical ones), badges and winnings disappear. The contract expires when the account is deleted. Deleting the account does not cancel a Premium subscription purchased in Google Play — it must be cancelled in Google Play (§ 11(4)).
- Signing out or uninstalling the app before synchronisation may erase unsent recordings from the phone.
- The Player may delete an individual Activity (activity screen; without a network, the deletion waits in the synchronisation queue). The server then recalculates municipality completions (the municipality remains if another Activity or a manual or photo entry completes it), the points and rankings of the current Season, and the progress of albums and challenges. Titles from closed Seasons, earned badges, completed albums and challenges, results of decided competitions and unlocked discounts remain.
§ 6. Rules of the game#
- Season points in a municipality = the number of distinct days (Polish time) with an Activity in that municipality × the total kilometres covered within its boundaries in the Season, where kilometres from a single day count only up to the daily limit (currently 20 km on foot and 60 km by bike). Regularity wins, not a single long expedition.
- There is a separate ranking for the “on foot” and “by bike” modes. The lead is calculated every hour, the Season closes on the first day of the following month, and the Player with the highest number of points becomes the Ruler of the Municipality. In the event of a tie, the order is determined by a fixed technical criterion (the order of account identifiers), the same for all Players.
- Municipalities added manually or from photos go into the collection and count towards collection badges, but do not give Season points, titles, club control of municipalities, challenges or discounts.
- Activities from watches and health apps are subject to the same rules as those recorded in the app (except Strava, § 3(6)).
- A club controls a municipality when the total points of its members in that municipality are the highest (at least 2 members with points).
- The step ranking is weekly and monthly, in the following views: friends, club, country and global. It counts steps counted by the phone's sensor while recording a walk or run (requires the Android “Physical activity” permission) and daily step totals from Health Connect (requires permission to read steps; entries added manually in Health Connect are not counted). The step ranking is a separate classification: steps do not give Season points, Ruler titles or control of municipalities. A Player's visibility in the step ranking depends on the profile privacy settings (with a private profile, strangers see “Private player”). The step ranking is not a prize competition unless the competition rules provide otherwise (§ 12).
- The Service Provider may change game parameters (thresholds, limits, the points formula, badges, albums) for valid reasons (game balance, fairness, performance, a change in boundary data), informing about it in the app. A change takes effect from the next Season, unless it serves to remove an error or abuse, and does not take away titles and badges already earned, unless they were earned in breach of § 7.
§ 7. Fair play#
- The following is prohibited:
- falsifying location (“fake GPS” apps, emulators, app modifications, manually crafted GPX files or data in Health Connect);
- completing routes by car, public transport, motorcycle or another motor vehicle (including an electric bicycle or scooter moving without pedalling) when the Activity is marked as a walk, run or bike ride; a pedal-assisted electric bicycle that requires pedalling is permitted in the “by bike” mode;
- recording the same route on several accounts, using someone else's account, creating additional accounts;
- artificially inflating steps (devices or apps simulating walking, shaking the phone, steps attributed to riding a vehicle, faking data in Health Connect);
- automation (bots), circumventing request limits, interfering with the operation of the server, bulk data downloading.
- The server automatically rejects points with an accuracy worse than 50 m and segments with a speed above: 12 km/h (walk), 30 km/h (run), 50 km/h (bike). Rejected fragments do not complete municipalities or give points. This is automatic data filtering, not a sanction against the Player.
- A suspicious result (route, steps, ranking position) can be reported by e-mail to kontakt@roamcrown.com, stating the Player's name, the municipality or ranking and a description. Reports are reviewed by an administrator. Reports must not be abused against other Players.
- In the event of a breach of the Terms of Service, the Service Provider may, in proportion to the seriousness of the
breach:
- invalidate an Activity — it remains in the Player's history but does not complete municipalities or places and gives no points, ranking positions, progress in albums or challenges, or results in competitions;
- disregard steps from a given period or exclude the Player from the step ranking for a fixed period or indefinitely;
- suspend the account for a fixed period (no more than 12 months) — during the suspension the account cannot be used, the Player's results disappear from rankings, competitions, leads in municipalities, club control and municipality duels, and the public profile is unavailable; after the period ends the account works again automatically, and the data and history remain;
- block the account indefinitely (with the same effects as a suspension) or terminate the contract (§ 17(2)). Titles from closed Seasons, badges and prizes already awarded remain in the history; the withdrawal of a competition prize is decided by the competition organiser in accordance with the competition rules.
- Decisions on sanctions are taken by a human (an administrator), not by an algorithm. Each decision is recorded in a moderation log (type of decision, date, reason, person deciding).
- The Player receives a statement of reasons for each sanction and each change to their content (Article 17 DSA): the type of decision, its scope and duration, the reason (the facts and the provision of the Terms of Service breached) and information on how to appeal — in the notification inbox in the app and by push notification, and, if the account has an e-mail address (from the Google account or provided at registration), also by e-mail. A suspended or blocked account also sees the decision on the “Account suspended” / “Account blocked” (Konto zawieszone / Konto zablokowane) screen, which appears when trying to sign in or use the account.
- Appeal. Any sanction can be appealed directly in the app (the form also works on a suspended or blocked account, up to 2000 characters) or by e-mail to kontakt@roamcrown.com, within 6 months of being informed of the sanction. The author of content changed or removed by a moderator (§ 8(3)) may appeal in the same way, as may a reporter who disagrees with the decision on their report (by e-mail, replying to the message about the decision). The appeal is reviewed by a human, where possible a different person from the one who took the decision, within 14 days. The reply with reasons is visible in the app (for an appeal by e-mail — by e-mail). If the appeal is justified, we reverse the decision. The Player may also use out-of-court dispute resolution (§ 15(5)) and the courts.
§ 8. User Content and community rules#
- Providing content of an unlawful nature is prohibited. The display name, profile photo, club name and description (name 3–40 characters, description up to 280) and the content of reports and appeals must not: infringe the law or personal rights, impersonate other persons, municipalities or institutions, contain offensive or vulgar content or content inciting hatred or violence, personal data of other persons, advertisements or links.
- Reporting content (Article 16 DSA). Anyone — including a person without an account — may report content they
consider illegal or incompatible with the Terms of Service:
- in the app — using the “Report” (Zgłoś) button (flag) next to a player (friends list, search, club members) and on the club screen; reporting requires being signed in and an internet connection;
- on the website — using the form at https://roamcrown.com/zglos (the “Report content” (Zgłoś treść) link on a player's profile and in the footer of every public page), without signing in; the reporter's e-mail is optional, but without it we cannot send information about the decision;
- by e-mail to kontakt@roamcrown.com (e.g. a club or other content that cannot be identified in the form). In the report you identify the content (the player's name or photo, the club's name or description), choose a reason (offensive content, spam, impersonation, illegal content, other), explain why the content is illegal or incompatible with the Terms of Service (for “illegal content” and “other” a description is required), and declare that the report is made in good faith and that the information is accurate and complete. A first and last name is not required; when reporting by e-mail, state the page address, the profile or club name, or attach a screenshot. We confirm receipt of the report (in the app immediately on screen, on the website — on screen and by e-mail if one was provided), process it without undue delay, in an objective and non-arbitrary manner, and inform the reporter of the decision with reasons (in the notification inbox in the app or by e-mail) and of the possibility of appeal (§ 7(7), § 15(6)). The author of the content does not learn who reported it. Reports must not be abused: in the case of manifestly unfounded reports submitted frequently, we may, after a warning, stop processing them for a period of time (Article 23 DSA).
- The Service Provider may remove or change non-compliant content (change the player's or club's name to a neutral one, hide the profile photo, remove the club description) and apply the sanctions under § 7(4), with a statement of reasons and the right of appeal as in § 7(6)–(7). A hidden profile photo does not return at the next sign-in until a moderator reverses the decision. We notify the competent authorities of content indicating a criminal offence threatening the life or safety of persons (Article 18 DSA).
- We do not use automated tools to moderate User Content or to take decisions on accounts; moderation is carried out by a human on the basis of reports and our own verification.
- The User grants the Service Provider a free, non-exclusive licence to display their Content in the Service (including on the public websites) for the lifetime of the account, to the extent necessary for the operation of the Service.
- The founder of a club is responsible for its name and description and may remove members. When the founder's account is deleted, the club passes to the longest-standing member.
§ 9. Public pages and visibility#
- If a Player sets a public profile, their name, profile photo, completed municipalities (map), number of badges, Ruler titles and ranking positions are publicly visible, including on the websites without signing in, and may be indexed by search engines.
- Routes are never public. You share the activity card yourself; by default it trims 200 m from the start and end of the route. By disabling trimming, you risk revealing, for example, your home address.
- The feed is visible to friends and club members (with a private profile, only to friends).
§ 10. Premium — scope and prices#
- Premium gives access to additional features: (a) a route planner through the nearest not-yet-completed municipalities in the app, with GPX export and opening in navigation, (b) offline maps (the base map of a chosen voivodeship to download to the phone), (c) full monthly statistics (without Premium: the current and two previous months) and the history of rankings and Rulers of older Seasons (without Premium: the current and previous Season), (d) rare badges marked “Premium” (Cartographer, Heritage Guardian, Chronicler) — anyone can see their progress, but they can only be earned with active Premium. Premium does not give points, titles or an advantage in rankings.
- Plans and prices. Monthly plan: 14,99 zł gross per month; annual plan: 99 zł gross per year. Prices include VAT and there are no additional charges (e.g. for delivery). The binding price and period are those shown before purchase: in the app on the purchase button (the price comes directly from Google Play; outside Poland, Google Play may show the price in the local currency) or in the web panel on the Premium screen and on the Stripe payment page. When purchasing on the website, the gross price is in złoty and is the same in all European Union countries: it includes VAT at the rate of the consumer's country (in Poland 23%; for consumers from other EU countries, the VAT of their country, settled under the OSS procedure). When a business with a valid EU VAT number from another country purchases, the tax may be accounted for by the buyer (reverse charge); the amount payable does not change. When a price is reduced, we also state the lowest price from the 30 days before the reduction.
- Free trial period and promotions.
- For the duration of the beta version, when purchasing in the app via Google Play, both plans (monthly and annual) come with a free trial period: the first month free. It is available to new subscribers, once per Google account: anyone who has already had a Premium subscription or used a trial period on that Google account purchases without a trial period. Eligibility for the trial period is determined by Google Play; the app shows the trial period only when Google Play offers it. There is no trial period when purchasing on the website (Stripe).
- Before purchase, the app shows the length of the trial period, the date of the first payment (purchase date + trial period), its amount (the plan price under para. 2) and how to cancel. During the trial period Premium works in full, and you pay nothing.
- If you do not cancel the subscription before the end of the trial period, it automatically converts into a paid subscription: Google Play charges the plan price on the day the trial period ends, and the subscription then renews in accordance with § 11(1). Cancelling during the trial period (§ 11(3)) costs nothing: Premium works until the end of the trial period and no fee is charged.
- The Service Provider may end the trial period offer or change its length for new purchases; this does not affect trial periods already started. For a promotional code or other promotion, its conditions, the price after it ends and the date of the first payment are shown before purchase.
- Purchase channels. Premium can be purchased:
- in the Android app — via Google Play (payment is handled by Google under Google Play terms, using the payment method saved in the Google account; Google issues the purchase confirmation and accounts for VAT on that transaction);
- on the website (panel, Premium → “Buy via Stripe” (Kup przez Stripe)) — by card or another method made available on the payment page, when the panel shows the purchase button. Payments on the website are processed by Stripe Payments Europe, Limited (Dublin, Ireland); you provide your card details directly to Stripe and they do not reach the Service Provider. On the payment page you accept the Terms of Service, and a business may provide its NIP / EU VAT number. The VAT invoice is issued on behalf of the Service Provider by Stripe and sent by e-mail; it is also available in the Stripe customer portal (“Manage subscription” (Zarządzaj subskrypcją)). You are entitled to an invoice for every purchase on the website: if you have not received it or need a business invoice issued later, write to kontakt@roamcrown.com. When purchasing in Google Play, VAT is accounted for by Google as the seller (intermediary), so the proof of purchase is issued by Google Play. The subscription status from Google Play is handled for the Service Provider by RevenueCat, Inc., and that of purchases on the website — by Stripe (Privacy Policy, points 3.10 and 5). One subscription works on one Player account: while Premium from Google Play is active, purchasing on the website is blocked, and the app does not show the purchase option while Premium is active (including Premium bought on the website), so that you do not pay twice. The app does not direct you to purchase on the website.
- Conclusion of the contract. You conclude the Premium contract with the Service Provider when you confirm the purchase (the purchase button in the Google Play payment window or on the payment page) and the payment is successfully authorised; with a trial period (para. 3) — when you confirm the subscription with a trial period in the Google Play window, i.e. at the start of the trial period (Google Play may verify the payment method at that point without charging a fee). We send confirmation of the conclusion of the contract on a durable medium by e-mail without undue delay after the contract is concluded (usually within a few minutes): the Service Provider's details, the plan, the gross price, the period, the renewal and cancellation rules, information on the right of withdrawal (§ 11(6)–(8)) with the model withdrawal form, and the Terms of Service as an attachment; with a trial period, also its end and the date and amount of the first payment. When purchasing on the website, the e-mail goes to the address provided at payment or the Player account address; when purchasing in Google Play — to the Player account address, if you are signed in and the account has an e-mail address (otherwise, the confirmation is the e-mail from Google Play, and the Terms of Service are available in the app and at the address in § 1(7)). Premium works immediately after purchase.
- Account and devices. Premium is assigned to the Player account (after signing in, it works in the app and in the web panel), and when purchased in Google Play also to the Google Play account. Without signing in, Premium purchased in Google Play works on the device with the Google Play account on which it was purchased; features that use the server (statistics, Season history, Premium badges) require a Player account. “Restore purchases” on the Premium screen transfers the subscription to a new device or after reinstallation. Without internet access, the app uses the most recently checked subscription status (until the end of the paid period, and for a renewing subscription for up to 3 days after it).
§ 11. Premium — renewal, cancellation, withdrawal, refunds#
- Renewal. The subscription renews automatically for a further period of the same length, and the fee is charged at the start of each period until you cancel the subscription. With a free trial period (§ 10(3)), the first fee is charged on the day it ends, and subsequent periods are counted from that day.
- Price change. We give notice of a price increase for an ongoing subscription (for a purchase in Google Play — via Google Play, under the store's rules; for a purchase on the website — by e-mail) at least 30 days before the first payment at the new price. A price increase requires your consent where the law or the store's rules require it; you can always cancel the subscription free of charge before the change.
- Cancellation is possible at any time, without giving a reason and free of charge:
- purchase in Google Play — in Google Play (Profile → Payments & subscriptions → Subscriptions) or using the “Subscriptions in Play Store” (Subskrypcje w Sklepie Play) / “Manage subscription” (Zarządzaj subskrypcją) button on the Premium screen in the app;
- purchase on the website — in the web panel (Premium → Manage subscription), which opens the Stripe customer portal; you can also write to kontakt@roamcrown.com.
- After cancellation, Premium works until the end of the paid period and does not renew. After cancellation during the free trial period, Premium works until the end of the trial period, the subscription does not convert into a paid one and no fee is charged, provided you cancel before the end of the trial period. Neither deleting the app nor deleting the Player account cancels the subscription in Google Play — it must be cancelled in Google Play. We cancel a subscription purchased on the website ourselves when the account is deleted (with immediate effect, without further payments).
- We do not refund the fee for the unused part of the period after cancellation, unless this follows from paras. 6–8, from the law or from the Google Play rules.
- Right of withdrawal. A Consumer (and a trader with consumer rights) may withdraw from the Premium contract within 14 days of its conclusion, without giving a reason and without costs, subject to para. 7. It is sufficient to send a statement before the deadline expires, e.g. by e-mail to kontakt@roamcrown.com (state the Player account e-mail and the number from the confirmation: “GPA…” for a purchase in Google Play, “sub_…” for a purchase on the website), or in writing to the address in § 1(2). You may use the model form (Annex 2 to the Act on Consumer Rights; it is also included in the e-mail confirming the conclusion of the contract), but this is not mandatory. We will confirm receipt of the statement by e-mail. With a free trial period (§ 10(3)), the 14-day period also runs from the conclusion of the contract, i.e. from the start of the trial period, not from the first payment.
- Immediate commencement of performance. Premium is a digital service supplied immediately after purchase. By purchasing Premium, you request that performance begin before the withdrawal period expires. If you withdraw from the contract within that period, we refund the fee less an amount proportionate to the period during which Premium was active until the moment of withdrawal (Article 35 of the Act on Consumer Rights). If, before purchase, you give express consent to full performance of the service before the withdrawal period expires and acknowledge that you will lose the right of withdrawal once the service has been fully performed, that right expires upon full performance of the service (Article 38(1)(1) of the Act on Consumer Rights). For digital content not supplied on a tangible medium for which you pay (e.g. one-off downloadable files), the right of withdrawal expires when supply begins, if this took place with your express prior consent, after being informed of the loss of the right of withdrawal, and you have received confirmation of that consent (Article 38(1)(13) of the Act on Consumer Rights). Without such consent, the right of withdrawal does not expire.
- Refund of payment after withdrawal is made without undue delay, no later than 14 days after receipt of the statement, using the same payment method you used (purchase in Google Play — refund via Google Play; purchase on the website — refund via Stripe to the card or account), unless you expressly agree to another method that involves no costs. Upon the refund, Premium stops working and the subscription is cancelled (it will not renew). We calculate the refund amount in proportion to the unused part of the paid period, from the moment of receipt of the statement (para. 7). You pay nothing for the free trial period, so withdrawal during the trial period costs nothing, and the refund amount for that period is 0 zł; the subscription is cancelled and does not convert into a paid one. A full refund of payment (e.g. following a complaint) also ends Premium and cancels the subscription. Independently of this, you may submit a refund request directly in Google Play under Google's rules — this does not limit your rights against the Service Provider.
- After Premium ends, features revert to the free version. Earned Premium badges remain on the profile, and GPX files saved on the phone remain on the phone. Downloaded offline maps remain on the phone (you can delete them in “Offline maps” (Mapy offline)), but the app uses them again only after Premium is renewed.
- Suspension or blocking of the account (§ 7) does not cancel the subscription in Google Play; you can cancel it at any time (para. 3). If we terminate the contract, suspend or block the account without a breach of the Terms of Service by the Player (e.g. by mistake, as revealed after an appeal), we refund a proportionate part of the fee for the period during which Premium did not work.

- Each competition has separate rules (link in the app next to the competition), which specify the organiser, the participants, how the winners are selected, the prizes and complaints. In the event of a conflict, the competition rules prevail. Template: regulamin-konkursu-wzor.md.
- The outcome of a competition is determined by the Players' sporting results according to the rules set out in its competition rules. Participation in a competition is free of charge and does not require purchasing Premium.
§ 13. Municipality challenges and partner discounts#
- Sponsored challenges and discounts are offered by municipalities and local businesses (partners). A discount code is unlocked automatically once a condition is met (e.g. completing a municipality with a route, a Ruler title, completing a challenge).
- You conclude the contract for the sale of goods or services at a discount with the partner, not with the Service Provider. The partner is responsible for honouring the discount and for the quality of the goods or services. The conditions (validity, number of codes, address) are stated with the offer.
- The Service Provider does not pass the Player's data to the partner; you show the discount code to the partner yourself.
§ 14. Conformity of services with the contract, updates, safety and liability#
- The Service Provider is liable to the Consumer for the conformity of digital content and digital services with the contract (Chapter 5b of the Act on Consumer Rights, Directive (EU) 2019/770) — throughout the entire period of their supply, including free services for which the Consumer provides personal data (Article 43a(2) and Article 7aa of the Act).
- Updates. We make app updates available, including security updates, necessary to keep the service in conformity with the contract, throughout the period of its provision, and we inform you about them (Google Play, information in the app). If you do not install an update within a reasonable time despite being informed about it and its consequences, we are not liable for a lack of conformity resulting solely from its absence. We may change the digital service for justified reasons (e.g. security, changes in the law, store requirements, a change of integration providers, development of features), at no additional cost to you. If a change significantly and negatively affects access to or use of the paid service, we inform you about it in advance on a durable medium, and you may terminate the contract within 30 days of the change and receive a refund of a proportionate part of the fee (Article 43m of the Act on Consumer Rights).
- Do not use the app while driving a vehicle. Do not look at your phone in traffic; you can disable “New municipality!” (Nowa gmina!) notifications in the settings.
- Outdoor activity involves risks (road traffic, weather, mountain terrain, fatigue, state of health). You decide on the route, pace and effort yourself; adapt them to your health and to the rules (road traffic, no-entry zones, private land, national parks and nature reserves, military areas). The app does not encourage entering places where entry is prohibited; places and historic monuments from the albums may be inaccessible or private.
- The Service is neither a medical device nor a navigation system. Data on distance, municipality boundaries and the location of places come from GPS and open sources and may be inaccurate. The route plan is a straight line, not a road route.
- We make every effort to ensure the continuity of the Service. We try to schedule technical breaks (maintenance, updates) at times of low traffic. The operation of the Service may be affected by factors beyond our control (GPS coverage, network failures, changes on the part of Google and watch providers).
- Towards Consumers, the Service Provider's liability arises from the law and is neither excluded nor limited. Towards Users who are not Consumers (or traders with consumer rights), the Service Provider's liability is limited to actual damage and to the amount of fees paid for Premium in the last 12 months; the limitation does not apply to damage caused intentionally or to personal injury.
- The Service Provider is not liable for the loss of points or titles resulting from a breach of the Terms of Service by the Player, or for recordings deleted by the Player before synchronisation.
§ 15. Complaints and dispute resolution#
- Complaints concerning the Service, including a lack of conformity of the digital service (free or Premium) with the contract, can be submitted by e-mail to kontakt@roamcrown.com or in writing to the address in § 1(2). It is helpful to state: the account e-mail, a description of the problem and the date it occurred, the request (e.g. bringing into conformity, price reduction, withdrawal from the contract), and for Premium — the purchase channel and the order number. Appeals against sanctions are submitted under the procedure in § 7(7).
- We respond to a complaint within 14 days of receiving it, by e-mail (or in writing, if the complaint was submitted in that form). Failure to respond within that period means that the Consumer's complaint is accepted.
- If the digital service is not in conformity with the contract, the Consumer may demand that it be brought into conformity. Where this is impossible, has not happened within a reasonable time or the lack of conformity is significant, the Consumer may demand a price reduction (Premium) or withdraw from the contract (Articles 43i–43k of the Act on Consumer Rights). Amounts due are refunded within 14 days, using the same payment method.
- Matters concerning the payment itself in Google Play (e.g. a double charge) may also be handled by Google under its rules, and payments on the website by the card issuer (chargeback procedure). This does not limit the Consumer's rights against the Service Provider.
- Out-of-court dispute resolution. The Consumer may use, among other things, the free assistance of a municipal or county consumer ombudsman, consumer organisations (e.g. the Federacja Konsumentów (Consumer Federation)), mediation or the arbitration court at the voivodeship inspectorate of the Trade Inspection (competent for the Service Provider: Dolnośląski WIIH in Wrocław), and in cross-border disputes within the EU — the assistance of the European Consumer Centre. The register of entities authorised to resolve consumer disputes out of court is kept by the President of UOKiK (Office of Competition and Consumer Protection, uokik.gov.pl). The Service Provider's participation in out-of-court proceedings is voluntary. The EU ODR platform was discontinued on 20 July 2025.
- In matters concerning moderation decisions, the User may also use a certified out-of-court dispute settlement body within the meaning of Article 21 DSA, where such a body is available.
§ 16. Intellectual property and data sources#
- The app, its appearance, the name “Roamcrown” (including in combination with the subtitle “Władca Gminy”), the logo, badges and texts belong to the Service Provider or are used under licence. They may not be copied or distributed beyond permitted use.
- The Service uses open data, which have their own licences:
- boundaries of municipalities, counties and voivodeships: National Register of Boundaries (Państwowy Rejestr Granic), source: Head Office of Geodesy and Cartography (© GUGiK);
- places for albums (peaks, national parks, lighthouses, castles, the Vistula) and some locations of historic monuments: © OpenStreetMap contributors, Open Database License (ODbL) 1.0 (openstreetmap.org/copyright);
- base map in the app: OpenFreeMap, © OpenMapTiles, data © OpenStreetMap contributors;
- historic monuments: National Heritage Board of Poland (Narodowy Instytut Dziedzictwa, NID), data from dane.gov.pl, licence CC BY 4.0; the data have been processed (category normalisation, combining names with addresses, grouping, coordinate conversion); NID is not responsible for these changes;
- coordinates and links: Wikidata (CC0);
- fun facts about municipalities and the list of the Crown of Polish Mountains (Korona Gór Polski): Wikipedia, licence CC BY-SA 4.0, with a link to the article.
- Attributions are shown on the maps in the app, with albums and place cards, and on the websites.
§ 17. Termination of the contract#
- The Player may terminate the contract for free services at any time by deleting the account. The Premium contract ends upon expiry of the period in which the subscription was cancelled (§ 11).
- The Service Provider may terminate the contract for valid reasons (gross or repeated breach of § 7 or § 8, breach of the law) with 14 days' notice, and in the case of a gross breach — with immediate effect, stating the reason (§ 7(6)) and with the right of appeal (§ 7(7)). It may also discontinue the Service with 60 days' notice, enabling data export and refunding a proportionate part of the fee for the paid, unused Premium period.
- An account unused for 24 months (no sign-in and no uploaded Activity) is deleted in the same way as with “Delete account” (Usuń konto). 30 days before deletion, the Player receives a notification in the app; simply opening the app (signing in) is enough to keep the account.
§ 18. Changes to the Terms of Service#
- The Service Provider may change the Terms of Service for valid reasons: a change in the law or a decision of an authority, new features or services, security, a change in the rules of the game, store requirements, a change of payment or integration providers.
- We give notice of a change in the app (at the next launch, a screen for accepting the new version is shown), and to Players with a Premium subscription purchased on the website also by e-mail, at least 14 days before the changes take effect. The changes do not affect already paid Premium periods as regards the price.
- A Player who does not accept the changes may, before they take effect, terminate the contract by deleting the account (and cancelling Premium, with a refund of a proportionate part of the fee for the unused period, if the change concerns Premium). We make previous versions of the Terms of Service available on request.
§ 19. Final provisions#
- The governing law is Polish law. For Consumers from other EU Member States, this does not deprive them of the protection of the provisions that cannot be derogated from by agreement under the law of their country.
- Disputes with Consumers are resolved by the court having jurisdiction under the general rules; disputes with traders (other than traders with consumer rights) — by the court having jurisdiction for the Service Provider's registered office.
- The provisions of the Terms of Service do not limit Consumers' rights arising from mandatory provisions of law. Should any provision prove invalid, the remaining provisions remain in force.
